Terms of Service

1. Acceptance

By creating an account on SDV — Source Document Vault — or by using any part of the service, you agree to these Terms of Service. If you are using SDV on behalf of an organisation, you represent that you have authority to bind that organisation. If you do not agree, do not use SDV.

2. What SDV is

SDV is a document vault and evidence-chain platform. We cryptographically seal documents you originate and provide tools to link related documents into an auditable chain. SDV is not a Qualified Trust Service Provider (QTSP) under eIDAS. SDV's biometric seal is a strong cryptographic and procedural integrity signal — it is not equivalent to a notarised electronic signature for jurisdictions that require QTSP certification.

3. Your account responsibilities

You are responsible for the accuracy and lawfulness of every document you originate, upload, or seal. SDV verifies the integrity of the document you provide; SDV does not validate the truth of its content. You are responsible for keeping your credentials secure and for all activity under your account.

4. Prohibited uses

• Creating, sealing, or sharing fraudulent or fabricated documents.
• Documents containing illegal content under any applicable jurisdiction.
• Use to facilitate money laundering, tax evasion, or sanctions evasion.
• Attempting to bypass authentication, rate limits, or jurisdiction controls.
• Reselling or sublicensing access without a written agreement.

Accounts found violating this section may be suspended without refund. Sealed documents remain in the vault under their legal retention period.

5. Data and documents

You own the documents you put in your vault. TonGuy Platforms holds them under your jurisdiction's legally required retention period and cannot delete a sealed document before that period expires — even if you ask us to. This is a deliberate property of the evidence vault and is the same reason the seal itself has legal value. Account-level data (profile, preferences) is governed by the Privacy Policy.

6. Subscription and billing

Paid plans are billed monthly through Stripe. New subscriptions include a 14-day free trial with no charge if cancelled inside the trial window. Cancellation takes effect at the end of the current billing period; we do not refund partial months. Prices may change with at least 30 days' notice to your account email.

7. Service availability

We aim for 99.9% monthly uptime on paid plans. Planned maintenance is announced by email at least 24 hours in advance and scheduled outside business hours of the user's primary jurisdiction where possible. The free tier is provided as-is, with no service-level guarantee.

8. Limitation of liability

To the maximum extent permitted by law, TonGuy Platforms' aggregate liability arising from your use of SDV is capped at the subscription fees you have paid to us in the twelve months preceding the event giving rise to the claim. We are not liable for the actions of third parties who receive a sealed document from you, nor for misuse of a document outside the platform.

9. Governing law

These Terms are governed by the law of the Federal Republic of Germany. The GDPR applies to all users in the EU. The Zimbabwe Electronic Transactions and Electronic Commerce Act applies to users with a Zimbabwean primary jurisdiction. Disputes that cannot be resolved through good-faith negotiation will be brought before the competent courts of Frankfurt am Main, Germany, unless mandatory consumer protection law of your jurisdiction provides otherwise.
